By accessing or using GizmoBot (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all users of the Service, including bot users and dashboard visitors.

2. Description of Service

GizmoBot is a Discord bot and web dashboard that provides server management, moderation, notifications, and other features for Discord communities. The Service includes both free and premium features, which may change from time to time at our discretion.

3. User Accounts and Authentication

3.1 Account Requirements

To use the Service, you must:

• Have a valid Discord account
• Be at least 13 years of age (or the minimum age in your jurisdiction)
• Comply with Discord's Terms of Service and Community Guidelines

4. Acceptable Use

5. Premium Features and Payments

5.1 Premium Subscriptions

Premium features are available through paid subscriptions. Subscription fees are charged in advance on a recurring basis (monthly or annually) and are non-refundable except as required by law.

5.2 Payment Processing

Payments are processed through third-party payment processors (such as Stripe). You agree to provide accurate payment information and authorize us to charge your payment method.

5.3 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. We do not provide refunds for partial subscription periods, except as required by law or at our sole discretion.

5.4 Price Changes

We reserve the right to change subscription prices. We will provide advance notice of price changes, and changes will apply to subsequent billing periods.

6. Partnership Agreements

Partnership agreements with GizmoBot are exclusively established through direct communication and negotiation with the entity seeking partnership (including but not limited to companies, content creators, streamers, and organizations). For legal and operational reasons, we do not enter into partnership agreements through intermediaries, agents, or third-party representatives. All partnership inquiries must be made directly by the prospective partner or an authorized representative with documented legal authority to act on behalf of the entity.

7. Intellectual Property

The Service, including all content, features, and functionality, is owned by GizmoBot and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. User Content

8.1 Your Content

You retain ownership of any content you submit through the Service (such as bot configurations, custom messages, and embeds). By submitting content, you grant us a license to use, store, and display that content as necessary to provide the Service.

8.2 Content Responsibility

You are solely responsible for your content and the consequences of posting it. We do not endorse or guarantee the accuracy of user content.

9. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify or discontinue features at any time without notice.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service or other users
• Non-payment of fees

Upon termination, your right to use the Service will immediately cease. We may delete your data in accordance with our Privacy Policy.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIZMOBOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless GizmoBot and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of others.

14. Dispute Resolution

14.1 Governing Law
